<p id="4tvwh1486">Terms that are often confused – yet every land or property buyer should understand what they mean before signing anything.</p>



<p id="77s0d192">Whenever someone starts looking to buy land or plans to build on the Croatian coast, the same question arises: “Which document do I actually need?” Location information, a building permit and an occupancy permit sound similar, are often mentioned in the same sentence, but in practice they represent completely different things – and different stages of the process.</p>



<h2 class="wp-block-heading" id="qxxbp194">1. Location Information – The First and Simplest Step</h2>



<p id="oizv8196">Location information is the simplest of these three documents and is usually the first thing to check when considering the purchase of land. It is a non-administrative document containing information about the designated use of a specific area based on the applicable spatial planning documentation. In other words, it tells you what is permitted to be built on a particular plot according to the valid spatial development plan.</p>



<p id="3p53r198">It is issued quickly, usually within eight days of submitting the application, together with a copy of the cadastral map. It is important to emphasise that location information itself does not allow construction to begin or the preparation of project documentation required for obtaining permits – it serves solely as an informational document. Precisely for this reason, it is the ideal first and quick step before hiring an architect or designer.</p>



<p id="lipk2200"><strong><em>Our advice:</em></strong> whenever you are considering purchasing land for construction, request location information before planning any conceptual design.</p>



<h2 class="wp-block-heading" id="511de202">2. Site Analysis</h2>



<p id="ujduq204">A site analysis can be a very useful step before purchasing building land or starting to plan construction.</p>



<p id="3neyb206">Unlike location information, which provides an overview of the intended land use according to the spatial development plan, a site analysis offers a more detailed assessment of the construction possibilities of a specific plot. It generally includes a more comprehensive review of the applicable spatial planning documentation, building conditions, and other spatial and technical limitations that may affect the planned project on that particular site.</p>



<p id="xzz92208">Such an analysis can help buyers gain a clearer understanding of the land&#8217;s potential before making a decision and determine whether it meets their plans. It is particularly useful when planning to build a house or carry out an investment project.</p>



<h2 class="wp-block-heading" id="82obm210">3. Building Permit – The Document Without Which Construction Cannot Begin</h2>



<p id="i71i1212">A building permit is the document that officially opens the door to construction. It is an administrative act by which the competent authority authorises the investor to construct a specific building on a specific plot under precisely defined conditions. Without it, any construction – whether a house, an extension or larger auxiliary structures – is considered illegal, which can result in serious legal and financial consequences, including the inability to legally sell the property in the future.</p>



<p id="k5y3w214">To obtain a building permit, project documentation prepared by a licensed designer is required. The application is submitted to the competent construction and spatial planning authority, most commonly today through the electronic eDozvola system.</p>



<h2 class="wp-block-heading" id="ofniq216">4. Occupancy Permit</h2>



<p id="pv93z218">An occupancy permit is an administrative act confirming that the building has been constructed in accordance with the issued building permit and that it meets all prescribed requirements. It is issued after a technical inspection during which a commission (or an authorised official for simpler structures) verifies whether the building has actually been completed according to the approved project. According to the law, the competent authority must carry out the technical inspection within thirty days of receiving a complete application, while for simpler buildings this period is fifteen days.</p>



<p id="xk0fq220">Why is this so important for buyers and not only for investors who build? Because an occupancy permit is not just a formality. Without it, the completed building is not legally considered compliant, which has very specific consequences: banks generally refuse to approve mortgage loans for properties that do not have an occupancy permit.</p>



<p id="tbkr8222"><strong><em>Practical advice:</em></strong> if you are buying a newer house or apartment, do not only ask whether it has a building permit. Also ask whether an occupancy permit has been issued and verify that the actual condition of the property (floor plan, size, number of floors) matches the information stated in the permit. Minor changes made during construction without updating the permit often lead to complications during the technical inspection and later create difficulties when selling the property.</p>



<h3 class="wp-block-heading" id="4kam2228"></h3>



<h2 class="wp-block-heading" id="oee2i230">In short: What do you actually need?</h2>



<ul id="4dx2v232" class="wp-block-list">
<li><strong>Buying land and just starting to think about building?</strong> Request location information – it is a quick and affordable way to find out what is actually permitted to be built on the plot.</li>



<li><strong>Ready to start construction?</strong> A building permit is mandatory – without it, construction is not legal and the property cannot be legally sold later.</li>



<li><strong>Construction has been completed?</strong> Without an occupancy permit, the building is not legally considered compliant, and banks generally will not approve a mortgage loan for such a property.</li>
</ul>

<p>Buying real estate on the coast has always been one of the most sought-after investment options in Croatia. Whether it is an apartment for occasional family vacations or a property that will yield a stable return through tourist rentals, interest from both domestic and foreign buyers in attractive locations along the coast remains exceptionally high.</p>



<p>However, the beginning of 2025 brought significant legislative changes that fundamentally alter the rules of the game. With the entry into force of the new Building Management and Maintenance Act and amendments to the Hospitality Industry Act, buyers today must pay much closer attention to documentation, property types, and the new legal framework before purchasing.</p>



<p>Don’t worry, the story of buying rental properties in Croatia is far from over – it has simply been given new, clearer rules. To make your decision-making process easier, we bring you a clear and detailed overview of everything that has changed and what exactly this means in practice for you as a future owner.</p>



<p><strong>Why did the rules change in the first place?</strong></p>



<p>For years, tourist rentals in Croatia were fairly straightforward: you would buy an apartment, submit a categorization request, and within a few days, the keys were ready for your first guests. This brought an incredible boom to tourism, but over time, it also created serious challenges in daily life. Many multi-apartment buildings turned into &#8220;mini-hotels&#8221; overnight, leading to a decline in the quality of living, overloaded infrastructure, and frequent disagreements among tenants. The state decided to react in order to protect the quality of residential living and steer tourism toward a sustainable direction.</p>



<p><strong>What do the new rules bring?</strong></p>



<p>The main shift in this narrative relates to the division of the cards between apartments in buildings and holiday homes. The legislator decided to draw a clear line.</p>



<p><strong>1. Apartments in buildings (Short-term rentals under scrutiny)</strong></p>



<p>If a property is rented out for a period shorter than 30 days (i.e., classic Airbnb and Booking), it is now officially considered a short-term commercial rental.</p>



<ul class="wp-block-list">
<li><strong>The 66% + neighbors rule:</strong> If you buy a classic apartment in a residential building today and want to engage in short-term tourist rentals, you must first obtain the written consent of other co-owners who hold more than 66% of the building&#8217;s total area before you can receive categorization papers.</li>



<li><strong>The most important detail:</strong> This 66% must strictly include your immediate neighbors – meaning everyone with whom the property shares a wall, as well as the apartments directly above and below yours.</li>
</ul>



<p><strong>2. Multi-occupancy rentals</strong></p>



<p>The law has decided to put an end to overcrowded apartments. If you plan to rent an apartment to five or more adult, unrelated persons (which is often the case with accommodation for foreign workers or students), this is now considered &#8220;multi-occupancy rental.&#8221; For this form of rental, you also need the consent of 66% of the co-owners, including your immediate neighbors.</p>



<p><strong>3. Buildings become legal entities (Community of Co-owners)</strong></p>



<p>A completely new concept has been introduced – the &#8220;community of co-owners&#8221;. Buildings are now granted legal personality and their own OIB (Personal Identification Number). What does this mean for you? It will drastically simplify all administrative and legal proceedings. More importantly, it will be far easier for buildings to apply for EU funds and subsidies intended for facade renovation, energy retrofitting, and the installation of solar power plants. In the long run, this increases the value of the property itself.</p>



<p><strong>4. Streamlined decision-making in buildings</strong></p>



<p>To avoid situations where a single problematic tenant blocks the entire building, the required majorities for making key decisions have been reduced:</p>



<ul class="wp-block-list">
<li><strong>Emergency repairs:</strong> Consent from co-owners is no longer required at all; the building manager reacts immediately.</li>



<li><strong>Necessary repairs (e.g., roof or elevator repair):</strong> Consent from one-third (33%) of the co-owners is sufficient (previously, it required over 50%).</li>



<li><strong>Regular management (choosing a tenant representative, installing a new elevator):</strong> Consent from more than 50% of the co-owners is required.</li>



<li><strong>Investment maintenance (major new investments in the building):</strong> Consent from 80% of the co-owners is required (previously, 100% was required).</li>
</ul>



<p><strong>5. Extensive powers for municipal wardens</strong></p>



<p>Municipal wardens now have the legal authority to enter properties and monitor compliance with the law. They can order urgent measures to remedy irregularities if they notice:</p>



<ul class="wp-block-list">
<li>Unauthorized construction work that compromises the building&#8217;s structural integrity (e.g., knocking down load-bearing walls in an apartment).</li>



<li>Illegal enclosing of balconies or loggias.</li>



<li>Installation of air conditioning units or other devices on the street-facing facade of the building.</li>
</ul>



<p><strong>6. Stricter misdemeanor fines</strong></p>



<p>The new law introduced serious financial penalties for non-compliance:</p>



<ul class="wp-block-list">
<li><strong>For building managers who fail to do their job:</strong> from €700 to €5,500.</li>



<li><strong>For co-owners (apartment owners) who break the rules or perform illegal modifications:</strong> from €400 to as much as €10,000.</li>



<li><strong>For contractors performing illegal work on a building:</strong> from €5,500 to €10,000.</li>
</ul>



<p><strong>Who is a &#8220;host&#8221; and who is not?</strong></p>



<p>One of the biggest changes is the introduction of the official term &#8220;host&#8221;. A host is considered a renter who has a registered residence in the county or island where the property is located (e.g., renting a room in the house where they live). However, the law clearly emphasizes: a renter who provides accommodation services in a multi-apartment or commercial-residential building is not considered a host. This means that buying an apartment in a building with the intention of tourist rental is now legally considered a purely commercial activity, regardless of where the owner lives.</p>



<p><strong>What about existing categorizations and transitional periods?</strong></p>



<p>The law has also taken existing renters into account, leaving a transitional period of 5 years (until December 31, 2029) during which existing renters in buildings must align their consents so they do not lose their right to operate. Because of this, it is extremely important to check every property and its existing documentation individually.</p>



<p><strong>Local taxes tailored by cities</strong></p>



<p>There are no more universal rules for the entire country. From 2025, cities and municipalities have been given the right to independently determine the property tax rates and flat-rate taxes per bed. Certain cities can further restrict the issuance of new licenses in overburdened zones (such as old town centers) through their own local decisions, meaning that local spatial plans must also be studied in detail before purchasing.</p>



<p><strong>What does all this mean for you as a property buyer?</strong></p>



<p>These changes do not mean that buying a rental property is a bad idea – on the contrary, they introduce order to the market and protect your investment in the long run from unfair competition and neglected buildings. However, the profile of highly sought-after properties has shifted, and buyers&#8217; focus has moved to two secure options:</p>



<p><strong>A) Detached houses and villas</strong></p>



<p>Since the majority of the new legal restrictions apply to multi-apartment buildings, standalone properties, family houses, and luxury villas with pools are completely exempt from these rules. With them, there is no gathering of tenants&#8217; signatures or dependence on neighbors. That is why our buyers increasingly choose:</p>



<ul class="wp-block-list">
<li>houses with a pool,</li>



<li>villas with a higher level of privacy,</li>



<li>new constructions,</li>



<li>properties in quieter locations,</li>



<li>and properties that can be used year-round.</li>
</ul>

<p><strong>B) Apartments in buildings with an established business or purpose-built new constructions</strong></p>



<p>If you still wish to buy an apartment, it is crucial to check the co-ownership relationships in the building, whether the building has proper documentation (use permit), and what the local taxes are (which each municipality and city prescribes autonomously from 2025).</p>

<p>Buying your first property is one of the most important steps in life. To make it easier for young people to acquire their own home, the Regulation on Support for the Acquisition of the First Residential Property has been in force since January 1, 2025. This program enables a refund of real estate transfer tax and a refund of 50% of the VAT paid, all with the aim of making housing more accessible and encouraging independent living.</p>



<p>This measure is part of the National Housing Policy Plan of the Republic of Croatia, the first strategic document that provides a comprehensive vision of housing in the country. The goal is clear – to make housing affordable while maintaining quality and legal security.</p>



<h4 class="wp-block-heading" id="h-who-is-entitled-to-the-refund">Who is entitled to the refund?</h4>



<p>Financial support is available to Croatian citizens who meet specific conditions:</p>



<ul class="wp-block-list">
<li>the purchase agreement must be concluded after January 1, 2025,</li>



<li>the buyer must not be older than 45 years,</li>



<li>the applicant and family members must have residence at the purchased property’s address,</li>



<li>the real estate transfer tax or VAT must be paid,</li>



<li>the buyer and their immediate family must not already own another residential property.</li>
</ul>



<p>It is also important to note that the property must be used for housing – if it is sold, rented out, or left unused within five years, the support must be returned.</p>

<h4 class="wp-block-heading" id="h-what-is-the-maximum-size">What is the maximum size?</h4>



<p>The Regulation distinguishes between apartments and houses, and the size of the property depends on the household size. For example, a single person is entitled to support for an apartment up to 50 m², while a family of four can receive support for an apartment up to 90 m². For houses, the limits are increased by 50%. Larger properties may also be purchased (up to 50% larger), but the refund is calculated only within the prescribed size limits.</p>



<h4 class="wp-block-heading" id="h-how-is-the-support-calculated">How is the support calculated?</h4>



<p>The calculation basis is the useful floor area of the apartment or house multiplied by the average square meter price in the relevant municipality. These data are regularly published by the Ministry of Physical Planning, Construction and State Assets.</p>



<p>If the purchase price is higher than the average, the calculation is made according to the average price. If it is lower, the agreed price is used.</p>

<h2 class="wp-block-heading">The answer is yes, foreigners – in this case citizens of the European Union and Switzerland can rent out their property in Croatia to tourists.</h2>



<p class="has-medium-font-size">Appropriate authorization is issued by the Tourism and Economic Administration Department of the community in which the property is located. A private person can do the renting and this is therefore a so-called “civic service”.</p>



<p class="has-medium-font-size">An application for approval of the rental must be submitted to the above-mentioned administrative department, accompanied by an identity card, proof of ownership, permission to use the property, and floor plans with areas. You pay application fees and therefore fees for an inspection of the property. Officials from the administration department will personally view and inspect the property after the application has been submitted.</p>



<p class="has-medium-font-size">It is always better to apply in the winter months. During this time the application can be processed more quickly. The closer the start of the season is, the longer the office needs to process the application and the report, as most applications are submitted at this time.</p>



<p class="has-medium-font-size">If there are several owners of a property and since approval for renting can only be in one name, the other co-owners of the property must give their consent to renting in the name of one of them in writing or in person when submitting the application.</p>



<p class="has-medium-font-size">Furthermore, a person in Croatia must be authorized to receive mail in this matter.</p>



<p class="has-medium-font-size">Following the report and the submitted documentation, a notice is issued by the administrative department. Depending on the size, equipment and condition of the property, the management department assigns a corresponding number of stars and defines a maximum number of people to whom the apartment can be rented. There are precise conditions for the distribution of stars and the maximum capacity.</p>



<p class="has-medium-font-size">The decision will be forwarded to the tax office and the tourist office.</p>



<p class="has-medium-font-size">The tax office defines which taxes apply. The taxes payable are mostly flat rates based on the number of beds and so far these have always resulted in a satisfactory ramen for customers.</p>



<p class="has-medium-font-size">The tourist office enables guest registration online via eVisitor. The information system for tourist registration and deregistration,<strong><span style="color:#0381b7" class="has-inline-color"> <a href="https://www.evisitor.hr/eVisitor/en-US/Account/Login?ReturnUrl=%2FeVisitor%2Fcs-CZ">eVisitor</a></span></strong>, is available in 7 different languages.</p>

<p class="has-medium-font-size">➡️ These criteria were more than enough for a couple from Austria to decide to buy after a viewing with our agent. Both are entrepreneurs, very busy and travel a lot. Croatia has long been a favorite destination for them and is so close that they can drive there even for a weekend. They also considered locations like Poreč and Rovinj, but this apartment in Zadar just ticked all the boxes and more. Since they can only spend a few weeks a year in the property, it was important that the property was also suitable for tourist rentals. In this case, the investor has already planned the room layout and size in such a way that 4 stars can be achieved. Our agents speak German, so every step of the buying process was explained to customers in their native language, which gave them extra reassurance and full understanding as foreigners buying in Croatia.</p>

<p class="has-medium-font-size">Anyone who is considering the idea of buying a property in Croatia comes across the information that in order to buy a property in Croatia, the so-called “OIB” number must be obtained.</p>



<h3 class="wp-block-heading">The abbreviation “OIB” stands for “osobni identifikacijski broj” in Croatian, which translated into English means “Personal Identification Number”. The OIB number consists of 11 numbers.</h3>



<p class="has-medium-font-size">It is the permanent identification number of a person in Croatia, which is used for identification in official registers, everyday business, and data exchange. This number is assigned to a person or company by the Ministry of Finance or the tax office.</p>



<p class="has-medium-font-size">The OIB number was introduced in Croatia in 2009. It serves to computerize state administration, which contributes to its efficiency and at the same time reduces the administrative burden on citizens. The OIB number provides a better overview of the property of private and legal entities and of financial transactions. With the introduction of the OIB number, Croatian legislation was brought into line with European legislation.</p>



<p class="has-medium-font-size">Persons who are not Croatian citizens but who are or will be registered in official registers and are liable to pay taxes in Croatia must obtain an OIB number.</p>



<p class="has-medium-font-size">An OIB number must therefore be obtained in order to conclude the main contract for the purchase of a property in Croatia. After the purchase, you as the buyer must be registered as the new owner in the relevant registers (such as the land register and cadastral office). In addition, the purchase contract is immediately forwarded directly by the notary to the tax office to determine the tax obligations.</p>



<h3 class="wp-block-heading">The application to obtain the OIB number must be submitted to the tax office in Croatia.</h3>

<h3 class="wp-block-heading"><strong>How much is the real estate transfer tax when buying a property in Croatia? Who pays for this? Whom? When?</strong></h3>



<p class="has-medium-font-size">When buying real estate, you become liable for real estate transfer tax. If the seller is a legal entity in the VAT system, i.e. the purchase price includes VAT, then there is no obligation to pay real estate transfer tax.</p>



<blockquote class="wp-block-quote is-style-default is-layout-flow wp-block-quote-is-layout-flow"><p><em><strong><strong><em>In <span style="color:#0479ab" class="has-inline-color"><a href="https://www.emporia-realestate.com/">our</a> </span>ads, we always try to highlight if the property for sale is exempt from real estate transfer tax.</em></strong></strong></em></p></blockquote>



<h3 class="wp-block-heading"><strong><strong>The real estate transfer tax in Croatia is 3% of the market value of the property.</strong></strong></h3>



<p class="has-medium-font-size">The notary public forwards every concluded purchase contract to the Tax Authority. The Tax Authority decides on the real estate transfer tax based on the purchase contract and the stated purchase price compared to the market value of the property. The notice will be delivered to the buyer’s home address. The tax office now sends these tax notices in a very short time. The tax is transferred to the account of the municipality in which the property was purchased. The payment deadline is 15 days from receipt of the notice.</p>



<p class="has-medium-font-size">When paying real estate transfer tax, it is very important to enter the reference numbers correctly so that the payment is recorded properly. When making payment from abroad, we recommend contacting the municipality or Tax Authority office to check whether everything has been properly recorded so that no penalty interest accrue unnecessarily.</p>
